Version 1 · For Synkbay 1.x · Effective 17 October 2026
In short
- Synkbay is free to use for browsing and copying. Synkbay Pro is a one-time purchase for one Mac that covers every 1.x release.
- Synkbay never receives your files or usage data. It has no account and works offline.
- Copying, syncing and deleting change real data. Keep a backup of anything important.
- To the extent the law allows, our total liability is limited to what you paid. Your rights as a consumer under the law are not affected.
This summary is for convenience. The terms below are the agreement.
1. This agreement
This End-User License Agreement (the “Agreement”) is between you and synkbay.com (“Synkbay”, “we”, “us”). It covers the Synkbay application for Mac, its built-in user guide and any update within Synkbay 1 (together, the “Software”).
You accept this Agreement by clicking Agree when Synkbay first opens, or by activating a license key. If you do not agree, do not use the Software.
Nothing in this Agreement excludes or limits any right or remedy that you have under consumer-protection law and that cannot lawfully be excluded or limited.
2. License
The Software is licensed, not sold. We grant you a non-exclusive, non-transferable license to install and use it on Macs that you own or control, for personal or internal business use. Synkbay and its licensors keep all ownership and intellectual-property rights in the Software.
3. Free edition and Synkbay Pro
The free edition may be used without charge and with no time limit.
A Synkbay Pro license covers one major version, identified in the license (for example, a license for Synkbay 1 covers every release numbered 1.x). It is perpetual for that major version: it does not expire, and it ends only as set out in section 15. A Pro license may be active on one Mac at a time.
A later major version, such as Synkbay 2, may be a separate or paid upgrade. Upgrade offers, including any discount or grace period, are described on the purchase page at the time of purchase. Your licensed version keeps working when a new major version comes out, subject to section 8.
4. Trial
Without a license, each Pro feature may be used a limited number of times (currently 3), counted when the feature actually runs. When a feature's tries are used up, that feature stops; everything in the free edition keeps working. Your files, and files already copied with Synkbay, are not affected.
You must not reset, extend or repeat the trial by changing application data, identifiers or other technical means.
5. License keys and activation
- Your license key is sent by email after purchase. It must be activated in Synkbay within 7 days of being issued; after that it expires and a replacement can be requested through Purchase Help.
- Activation links the license to the Mac it is activated on, using a one-way code derived from that Mac's hardware identifier. The identifier itself is not stored or sent anywhere. A license copied to another Mac does not work there.
- To move to another Mac, request a new key through Purchase Help. You can get up to 2 new keys per order in any 12 months; the previous key stops working 7 days after the new one is issued. Reinstalling on the same Mac never needs a new key.
- License keys that are refunded, charged back, replaced by a new key, or shared in breach of this Agreement are listed as revoked. The Software checks a public list at synkbay.com when it starts and once a day, and later releases may also include the list. A revoked key stops unlocking Pro once the Software sees it on the list, after any Pro task in progress finishes; the free edition keeps working.
6. Your responsibilities
You may use the Software to browse, copy, organise and synchronise files on phones and other devices that you own, control or are authorised to access. You are responsible for:
- having the right to access each connected device and its content;
- making sure the files you copy do not infringe the law or anyone else's rights;
- keeping an independent backup of important data (section 7);
- the condition of your devices, cables and storage, and having enough free space.
You must not:
- copy, redistribute, rent, lease, sell or sublicense the Software, or share, publish or resell a license key, except as the law expressly permits;
- circumvent or interfere with license checks, trial limits, activation or other feature controls;
- reverse-engineer, decompile or disassemble the Software, except as the law expressly permits;
- remove copyright or other notices;
- use the Software to access a device or data without authorisation, to infringe privacy or intellectual-property rights, or to spread malicious software.
7. Your data, transfers and backups
Copying, replacing, renaming, deleting and synchronising change data on your Mac or your device. Synkbay is designed to reduce that risk: deleting asks for confirmation; files are written under a temporary name and given their real name only once complete; and sync folders copy new and changed files without deleting anything on either side. No transfer or storage operation is free of risk, however, and the result can be affected by the device, its software, the cable, the file system, or changes made outside Synkbay.
Synkbay is not a backup system and does not recover deleted, damaged or inaccessible files. Before using it, particularly to delete, replace or sync, keep an independent backup of anything you cannot afford to lose.
8. Compatibility and updates
Synkbay uses the Media Transfer Protocol (MTP) and the USB interfaces provided by macOS. What works, and how fast, depends on the device and its software, its MTP implementation, its security settings, the macOS version, the cable or hub, and other apps using the device. We do not guarantee that the Software works with every device, file, macOS release or future software update by Apple, Google or a device maker.
We may release fixes and updates within a major version. An update may need a newer version of macOS. We are not obliged to develop or release any particular update or a later major version.
9. Support
Support is offered by email at support@synkbay.com on a reasonable-efforts basis, with no guaranteed response or resolution time. Support does not include data recovery or the repair of hardware or other software.
10. Privacy
- Synkbay never receives your files. They go directly between your phone and your Mac.
- The app has no account and collects no usage data or analytics. It works without an internet connection. When it can, it downloads a public file from synkbay.com at launch and once a day, listing the newest version and revoked license keys; the request contains nothing about you, your Mac or your phone. Otherwise it goes online only when you open a website link, such as Buy or Help.
- Settings, transfer history and license details are stored only on your Mac.
- Help → Export Diagnostics… creates a report on your Mac only when you choose to. File names, device serial numbers, buyer details and license keys are removed from it. It reaches us only if you send it.
- When you buy Synkbay Pro, the Merchant of Record (MoR) (section 13) processes your name, email address and payment details under its own privacy notice. We receive your name, email address and order details to issue and support your license key.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Software is provided “as is” and “as available”, with all faults, and without warranties, representations or conditions of any kind, whether express, implied or statutory, including those of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, non-infringement and compatibility.
In particular, we do not warrant that the Software will be uninterrupted or error-free, that every device will be compatible, that every transfer will complete, that files will never be lost, corrupted, duplicated or overwritten, or that every error will be corrected.
This section does not exclude any warranty, guarantee or consumer right that cannot lawfully be excluded.
12. Limitation of liability
12.1 Excluded losses. To the maximum extent permitted by applicable law, Synkbay, its owner, developers, licensors and distributors are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of data or files, loss of profits, revenue, business, goodwill or anticipated savings, business interruption, or the cost of substitute software or of reconstructing or recovering data, arising out of or connected with the Software or this Agreement. This applies whether the claim is in contract, tort (including negligence), under statute or otherwise, and even if we were told such loss was possible.
12.2 Overall limit. To the maximum extent permitted by applicable law, our total liability for all claims arising out of or relating to the Software or this Agreement is limited to the price paid for your Synkbay license or, if you have not paid for one, US$10. This limit applies to all claims together, however many events, devices or legal theories are involved.
12.3 What is not limited. Nothing in this Agreement excludes or limits liability for fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability, warranty or consumer remedy that cannot lawfully be excluded or limited, including, where the law of your country provides it, liability for damage to your device or other digital content caused by our failure to use reasonable care and skill.
13. Purchases, refunds and our reseller
Synkbay Pro is sold through our Merchant of Record (MoR), which acts as our reseller. Your purchase, payment, taxes, receipts and refunds are governed by the MoR's buyer terms; your use of the Software is governed by this Agreement.
You may ask for a refund within 14 days of purchase, without giving a reason, through Purchase Help. A refunded license key may be revoked (section 5). This does not limit any statutory refund, repair or replacement right you have.
14. Your indemnity
To the extent permitted by applicable law, you agree to compensate Synkbay and its owner for third-party claims, and the reasonable costs of defending them, that arise directly from your unlawful use of the Software, your access to a device or data without permission, your infringement of someone else's intellectual-property or privacy rights, or your material breach of section 6. This does not apply to loss caused by our own fraud, wilful misconduct or breach of this Agreement.
15. Termination
You may stop using the Software at any time. We may end your license if you materially breach this Agreement, for example by sharing license keys, circumventing license checks, distributing unauthorised copies or using the Software to access devices unlawfully. When the license ends, you must stop using and delete the Software. Sections 7 and 10 to 19 continue to apply after it ends.
16. Trademarks and third parties
Synkbay, its software, interface, graphics, name and documentation are protected by copyright and other intellectual-property laws. The Software contains no third-party code. Android is a trademark of Google LLC; Mac and macOS are trademarks of Apple Inc. Their use does not imply endorsement.
17. Governing law and disputes
This Agreement is governed by the laws of India. Subject to the next sentence, the courts at Thiruvananthapuram, Kerala, India have jurisdiction over disputes arising from it. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim before the consumer commissions, courts or regulators that those laws make available to you.
You must comply with the export-control and sanctions laws that apply to you.
18. Changes
This version of the Agreement applies to Synkbay 1.x. We may publish a new version with a later release; Synkbay then asks you to agree again before you continue. A new version does not take away rights that have already accrued to you, and it never reduces the Pro features or major version that you have already paid for.
19. General
If any part of this Agreement is found invalid or unenforceable, it is enforced to the maximum lawful extent or removed, and the rest continues to apply. This Agreement, together with the MoR's buyer terms for your purchase and our privacy policy, is the whole agreement between you and us about the Software. If we do not enforce a term straight away, we can still enforce it later.
